We have a lot of really great apps here that will be a hit with your organization! We know you’re excited about them, too, and that you have lots to do. So, we won’t take much time here, but our lawyers tell us that you should read and agree to this sales and refund policy before you can complete your purchase. We’d rather just let you run, but you know lawyers...

Purchases and Payments

a. Free Apps Spark may allow you to download or use Apps free of charge. Any terms and conditions that apply to purchased Apps will apply to free Apps, except with respect to payment-related matters (for example, the refund-related provisions of this Sales and Refund Policy does not apply to free Apps). Spark may impose limitations on your access and use of certain free Apps.

b. Purchase of Apps Your contract for the purchase and use of an App is completed once you have received email from the Rock Shop confirming your purchase of the App. The Rock Shop allows you to purchase Apps using various payment processing methods, which are made available by third party payment processors. You must abide by any relevant terms and conditions or other legal agreement, whether with Spark or a third party, that governs your use of a given payment processing methods. Spark may add or remove payment processing methods at its sole discretion and without notice to you. Once your purchase is complete, Spark or Spark's payment processor may charge your credit card or other form of payment that you indicated for any App ordered, along with any additional applicable amounts (including any taxes). You are solely responsible for all amounts payable associated with purchases made by you or using your account at the Rock Shop.

c. Pricing Pricing and availability of all Apps available at the Rock Shop is subject to change at any time before you click the button indicating that you want to purchase the App.

d. Taxes You are responsible for any taxes associated with your purchases and must pay for Apps without any reduction for taxes. If the seller of the App is obligated to collect or pay taxes, the taxes will be charged to you. Taxes includes, without limitation, any duties, customs fees, or taxes (other than income tax) associated with the sale of the App, including any relating penalties or interest. You must comply with any and all applicable tax laws, including the reporting and payment of any taxes arising in connection with your use of the Rock Shop or the purchase of any Apps. The reporting and payment of any such applicable taxes are your responsibility.

e. All Sales Final Except as expressly set forth in the Refund section of this Sales and Refund Policy, all sales are final, and no returns, replacements or refunds are permitted. If a replacement, return or refund is granted for any transaction, the transaction may be reversed, and you may no longer be able to access the App that you acquired through that transaction. Your rights to withdraw, cancel or return purchases and get a refund are set out in the Refund section of this Sales and Refund Policy.

Defective Content Assistance.

Once an App is available for download by you, you should check the App as soon as possible to ensure that it downloads correctly and performs as stated, and notify us as soon as possible if you find any errors or defects. In the case of Provider Apps, you should contact the Provider concerning any defects or performance issues in the App, at the support url for that Provider (the "Provider Support Link") which is listed on the Rock Shop page providing information on the App. In the case of Spark Apps, you should contact Spark concerning any defects or performance issues in the App, by using the "Spark Support" link in the Rock Shop. Spark will use reasonable efforts to respond to your requests for defective content assistance, but all sales of Spark Apps are as is and final.

Refunds.

All sales of Spark Apps are as is and final. Refunds will not typically be provided by Spark. However, if Spark in its sole discretion issues you a refund or credit of your purchase price, you acknowledge that this is your sole remedy. If Spark issues any refund or credit, it is under no obligation to issue the same or similar refund in the future.

Providers may have separate refund policies for Provider Apps, which separate policies will be provided thru the Provider Support Link. You acknowledge that you must work solely with the Provider concerning any refund request for any Provider App and that Spark shall have no liability to you under any Provider refund policy.

It may take up to 30 days to process the refund or credit. Spark will notify you via e-mail once your refund or credit has been processed. Please note that your financial institution will likely take approximately ten business days to reflect this transaction.
